原子力の非軍事的利用に関する協力のための
日本国政府とアメリカ合衆国政府との間の
協定を改正する議定書

　　使用済燃料の平和利用の確保と提供燃料の増量を骨子とする日米原子力一般協定改正の議定書が10月9日調印された。この議定書の解説は来月号において紹介する予定であるが、本号においてはとりあえず日英両国語による議定書の全文を紹介した。またさきに原子力委員会の決定にもとづいて原子力関係科学者技術者養成の基礎資料を得る目的で行われたアンケートのうち民間企業に関する部分の集計が終了したので、中間報告の形で掲載した。

原子力の非軍事的利用に関する協力のための日本国政府とアメリカ合衆国政府との間の協定を改正する議定書

日本国政府及びアメリカ合衆国政府は、1958年6月16日にワシントンで署名された原子力の非軍事的利用に関する協力のための日本国政府とアメリカ合衆国政府との間の協定（以下「協力協定」という。）を改正することを希望して、次のとおり協定した。

第1条
　協力協定第5条A中「プルトニウムについては10グラム、U−233については10グラム」を「U−233については10グラム、加工された箔及び線源の形状のプルトニウムについては250グラム、他の形状のプルトニウムについては10グラム」に改める。

第2条
　協力協定第7条Cを次のように改める。

C　合衆国委員会は、要請を受けたときは、その裁量によって、前記の特殊核物質の一部を、ウランに含まれるU−235が8キログラムをこえない燃料の装備でそれぞれ運転することができる研究用及び材料試

第3条
　協力協定第7条F中「購入する優先権」の上に「平和的目的にのみ使用するため」を加える。

第4条

　この議定書は、それぞれの政府が、他方の政府から、この議定書の効力発生のための法律上及び憲法上のすべての要件を満たした旨の文書による通告を受領した日に効力を生じ、かつ、協力協定の効力の存続期間中効力を有する。

　以上の証拠として、下名は、正当に委任を受け、この議定書に署名した。
　1958年10月9日にワシントンで、ひとしく正文である日本語及び英語により本書2通を作成した。

PROTOCOL AMENDING THE AGREEMENT FOR COOPERATION BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE UNITED STATES OF AMERICA CONCERNING CIVIL USES OF ATOMIC ENERGY

The Government of Japan and the Government of the United States of America ;

Desiring to amend the Agreement for Cooperation between the Government of Japan and the Government of the United States of America Concerning Civil Uses of Atomic Energy, signed at Washington on June 16, 1958, hereinafter referred to as the "Agreement for Cooperation"; Have agreed as follows :

Article I

Article V, paragraph A, of the Agreement for Cooperation is amended by deleting the phrase "10grams of plutonium, and 10 grams of U-233" and substituting in lieu thereof the phrase "10 grams of U-233, 250 grams of plutonium in the form of fabricated foils and sources, and 10 grams of plutonium in other forms".

Article II

Article VII, paragraph C, of the Agreement for Cooperation is amended to read as follows :

"C. The United States Commission may, upon request and in its discretion, make a portion of the foregoing special nuclear material available as material enriched up to ninety per cent (90%) for use in research and materials testing reactors, each capable of operating with a fuel load not to exceed eight (8) kilograms of contained U-235 in uranium."

Article III

Article VII, paragraph F, of the Agreement for Cooperation is amended by inserting the phrase "for use for peaceful purposes only" immediately after the phrase "a first option to purchase".

Article IV

This Protocol shall enter into force on the day on which each Government shall receive from the other Government written notification that it has complied with all statutory and constitutional requirements for the entry into force of such Protocol and shall remain in force for the period of the Agreement for Cooperation.

IN WITNESS WHEREOF, the undersigned, duly authorized, have signed this Protocol.
